Implicit bias is a phenomenon that is prevalent in virtually all aspects of society. It refers to the tendency of individuals to harbor certain biases or prejudices about certain groups without being consciously aware of those feelings.
President Bush has signed the Pension Protection Act of 2006 into law, which overhauls pension funding rules, clarifies cash balance plan rules, encourages automatic enrollment in 401(k) plans, and much more. The law spans a massive 907 pages, and we describe some of its key provisions here.
What's an employer to do when there is ample documentation to terminate an employee, but the employee has recently engaged in a protected activity? For example, what if the employee files a workers' compensation claim or takes FMLA leave in close proximity to performance issues? This presents a real timing dilemma for employers: Doesn't it look retaliatory to terminate the employee immediately after the protected activity?
